Terms and Conditions
Article 1. Applicability.
1.1 These General Sales and Delivery Conditions apply to all offers, orders and agreements of TheBoardshop.EU, to the exclusion of any other general terms and conditions.
1.2 Accepting an offer or placing an order means that you accept the applicability of these Conditions.
1.3 It is only possible to deviate from the provisions of these Conditions in writing, in which case the other provisions remain in full force.
1.4 All rights and claims, as stipulated in these Terms and Conditions and in any further agreements for TheBoardshop.EU, are also stipulated for the benefit of intermediaries and other third parties engaged by TheBoardshop.EU.
Article 2. Offers / agreements
2.1 All offers from TheBoardshop.EU are without obligation and TheBoardshop.EU expressly reserves the right to change prices, in particular when this has become necessary for TheBoardshop.EU on the basis of (legal) regulations or a change in calculation or purchase price.
2.2 An agreement is only concluded after acceptance of your order by TheBoardshop.EU. TheBoardshop.EU is entitled to refuse orders or to attach certain conditions to the delivery, unless explicitly stated otherwise. If an order is not accepted, TheBoardshop.EU will communicate this as soon as this is possible for TheBoardshop.EU.
Article 3. Prices and payments
3.1 The prices stated for the products and services offered are in euros, including VAT and excluding handling and shipping costs. Exclusive of any taxes (outside the EU) or other levies, unless stated otherwise or agreed in writing.
3.2 Payment must be made in advance, via the payment methods selected by TheBoardshop.EU. TheBoardshop.EU works with a payment provider (MultiSafePay) for processing CreditCard transactions and does not store any financial data of customers itself.
3.3 Payment can be made under prepayment. When paying by bank or giro, the date of payment is the date of crediting the account of TheBoardshop.EU.
3.4 Rented goods remain the property of TheBoardshop.EU. These may not be disposed of, used improperly or otherwise damaged by the tenant and must be insured against all external calamities.
Article 4. Delivery
4.1 The delivery times stated by TheBoardshop.EU are only indicative. Exceeding any delivery period does not entitle you to compensation or the right to cancel your order or to dissolve the agreement, unless the delivery period is exceeded to such an extent that you cannot reasonably be expected to maintain the agreement. In that case you are entitled to cancel the order or to dissolve the agreement to the extent necessary.
4.2 The products are delivered by a carrier of your choice. Shipping costs are always reimbursed at the lowest possible rate. Emergency surcharges are not reimbursed.
4.3 TheBoardshop.EU accepts no delivery liability for orders without track & trace. We therefore recommend that you choose a shipping option with track & trace when ordering more expensive items.
Article 5. Complaints, returns and liability
5.1 You have the obligation to check whether the products meet the agreement upon delivery. If this is not the case, you must inform TheBoardshop.EU of this in writing and with reasons as soon as possible and in any case within three (3) days after delivery, at least after observation was reasonably possible.
5.2 If it has been demonstrated that the products do not comply with the agreement, TheBoardshop.EU has the choice to replace the products concerned after returning them (see also article 5.4) by new products or to refund the invoice value thereof.
5.3 If you do not wish to purchase a product for whatever reason, you have the right to return the product to TheBoardshop.EU within fourteen (14) days after delivery. In this case, returns are only accepted if the product and the original packaging are undamaged, whereby the costs for returns are also for your account. Furthermore, all conditions mentioned in article 5.4 also apply.
5.4 If, after consultation with TheBoardshop.EU, a return shipment is made, this must be sent to TheBoardshop.EU in the original packaging, with sufficient postage and sufficiently packed. If these conditions are not met, any additional costs incurred are for you. TheBoardshop.EU reserves the right to refuse unstamped shipments.

Article 6. Orders / communication
6.1 For misunderstandings, mutilations, delays or improper transmission of orders and communications as a result of the use of the Internet or any other means of communication in the traffic between you and TheBoardshop.EU, or between TheBoardshop.EU and third parties, insofar as it pertains to the relationship between you and TheBoardshop.EU, TheBoardshop.EU is not liable, unless and insofar as there is intent or gross negligence on the part of TheBoardshop.EU.
Article 7. Force majeure
7.1 Without prejudice to its other rights, TheBoardshop.EU has the right, in the event of force majeure, to suspend the execution of your order, or to dissolve the agreement without judicial intervention, by notifying you in writing. parts and such without TheBoardshop.EU being obliged to pay any compensation, unless this would be unacceptable in the given circumstances by standards of reasonableness and fairness.

Article 8. Miscellaneous
8.1 If one or more of the provisions of these Terms and Conditions or any other agreement with TheBoardshop.EU should conflict with any applicable legal provision, the relevant provision will lapse and will be replaced by a new legally permissible comparable provision.
8.2 TheBoardshop.EU is authorized to make use of third parties in the execution of your order (s).
Article 9. Applicable law and competent court
9.1 All rights, obligations, offers, orders and agreements to which these Conditions apply are exclusively governed by Dutch law.
9.2 All disputes between parties will be submitted exclusively to the competent court in the district in which TheBoardshop.EU has its principal place of business.
